Rules on Payment Collections for Alibaba.com Online Transaction Orders

Chapter I Overview

Article 1 These Rules are formulated in accordance with the Alibaba.com International Platform Rules (General Provisions), Alibaba.com Transaction Services Agreement, and Alibaba.com Supplemental Services Agreement, so as to safeguard the legitimate rights and interests of the transaction parties, and to maintain the normal operations of order payment on Alibaba.com.

Article 2 These Rules govern the collection of online payments for cross-border transactions in the manners prescribed by Alibaba.com, including but not limited to the collection by OneTouch that acts as the Seller's entrusted export and payment collection agent.


Chapter II Definitions

Article 3 Alibaba.com refers to the website (www.alibaba.com) and its mobile app.

Article 4 Online Transaction refers to the activity in which the Buyer and the Seller conduct cross-border transaction through the online trading system and relevant technical services provided by Alibaba.com.

Article 5 Transaction Order refers to the agreement on rights and interests reached by the cross-border transaction parties.

Article 6 OneTouch is a provider of integrated foreign trade services (see https://onetouch.alibaba.com/ for details), including but not limited to export customs declaration, logistics and transport, trade assurance and financing, collection and settlement of foreign exchange, and export tax rebate.


Chapter III Handling of Irregularities in Online Payment Collection

Article 7 Unreasonable and Improper Act of Payment Collection refers to the failure on the part of the Seller to collect payments for Online Transaction Orders in the manners prescribed by Alibaba.com or stipulated in the Transaction Order.

The collected payment does not correspond to the amount of the Transaction Order.

Alibaba.com will have the payment returned or suspend the Seller from collecting payment for the Transaction Order through the platform.


Payment from a third party unrelated to the transaction is collected by proxy.


Collection of payments from a third party that acts as an invalid payment agent of the Buyer.


The nationality of the payer does not correspond to the export destination or the place of receipt set out in the Transaction Order, and no reasonable explanation can be given in this regard.


The collected payment violates UN resolutions applicable to transactions on Alibaba.com or relevant State/regional laws and regulations (including trade sanctions of China, the US, the EU, etc.).


Payment for a canceled order is not returned.


The collected payment is not matched with the Transaction Order within 90 calendar days of collection.

Alibaba.com will have the payment returned.

As far as the Transaction Order is concerned, the payer applies through the paying bank for a payment revision or a refund.

Alibaba.com will temporarily freeze, or impose withdrawal restrictions on, payment for the Transaction Order collected by the Seller through the platform.


The Seller fails to provide genuine and valid evidence for the type of payment with respect to the Transaction Order.


The Transaction Order is suspected of violating relevant State/regional laws and regulations, and therefore investigated by competent State/regional regulatory or law enforcement authorities.


Article 9 Where the Seller entrusts OneTouch with export and payment collection with regard to a Transaction Order placed on Alibaba.com, but fails to collect the payment through OneTouch as per the rule of the State Administration of Foreign Exchange, stating "Whoever imports shall pay; whoever exports shall collect the payment.", such failure shall constitute violation of relevant State laws and regulations on the collection of foreign exchange. OneTouch is the payment collector, but not the exporter.

Alibaba.com will have the payment returned or suspend the Seller from collecting payment for the Transaction Order through Alibaba.com or OneTouch.


OneTouch is the exporter, but not the payment collector.

Alibaba.com will ban the Seller from entrusting OneTouch with the export.


Article 10 If the Seller violates these Rules and refuses to cooperate, Alibaba.com reserves the right to ban the Seller from using Online Transaction services of the platform.


Chapter IV Miscellaneous

Article 11 If the Seller who violates Articles 7 and 9 hereof fails to appeal within three working days after receiving the notice of violation from Alibaba.com, or if such an appeal is overruled, the platform will handle the violation in accordance with these Rules.

Article 12 The platform's handling of violation in accordance with these Rules does not exempt the Seller from its liability for compensation as stipulated by laws and regulations, other rules and protocols of Alibaba.com, the transaction contract or any other agreement between the transaction parties.

Article 13 Alibaba.com has the right to revise these Rules from time to time according to any amendments to the laws and regulations, changes in the operation environment, and other factors, and the revised rules will come into effect upon expiration of the statutory publicity period.

Article 14 These Rules constitute a part of the Alibaba.com International Platform Rules. In the case of any inconsistency between these Rules and the Alibaba.com International Platform Rules, these Rules shall prevail. For matters that are not covered herein, the Alibaba.com International Platform Rules shall prevail.
